  1. Confidentiality Policy

The Confidentiality Policy is aimed at users of the website http://www.sailhero.eu (hereafter referred to as « WEBSITE »), and to SAILHERO’s clients. Its objective is to inform users about the collection and processing of their personal data by SAILHERO.

 

This personal data is processed in compliance with the French Data Protection Act of 6 January 1978 (hereafter referred to as “FDPA”), and with the General Data Protection Regulation of 27 April 2016 (hereafter referred to as “GDPR”). 

In any case, we commit to respecting the two following principles:

  • You are the owner of your personal data;

  • Your data is processed in a transparent, confidential and secure manner.

Legal reminder: The person in charge of data processing is, according to the French Data Protection Act, the decision-maker regarding any methods, or the processing end-point. In a case where two processors or more are joint decision-makers regarding the end-points and the processing methods, they are jointly responsible for the processing. The subcontractor processes the personal data on behalf of the processor and is subject to the processor’’s authority and instructions.

ARTICLE 2. COLLECTION OF DATA AND DATA SOURCES

 

All your personal data is collected, either directly from you (information communicated via the contact form available on the WEBSITE when registering or when ordering products), or indirectly upon your visit to our website (connection and navigation data).

In any case, your personal data is collected and processed solely to manage your registration on the WEBSITE, to ensure the delivery of your products, to provide you with all the functionalities and services we offer, to allow us to improve our services and ensure an effective commercial follow-up.

Whenever deemed necessary, and on a case per case basis, we will commit to get your acceptance and/or to allow you to refuse the use of your personal data, i.e. To send commercial prospects or to install third party cookies in your browser in order to measure the usage of our website and to send notifications with promotional offers and ads which might be of interest to you.

  

ARTICLE 3. PURPOSE AND LEGAL BASIS OF PROCESSING

 

This data is necessary in order to enter into contract and ensure a possible follow-up, as well as to fulfill fiscal and financial obligations. The data remains confidential. It can be used in order to send promotional offers or commercial information.

The data will never be shared or transmitted.

  

ARTICLE 4. PROCESSED DATA

 

The data we collect is your surname, your first name, your birth date, your complete address, your phone number, your email address, as well as the CNI number, the boat type, its name, port and dock number.

 

When collecting data, you will be informed of the type of data being collected, either mandatory or optional, and of the possible consequences of a non-reply on your behalf.



ARTICLE 5. DATA RECIPIENTS

 

Within the limit of attribution and to fulfill the purposes set forth in Article 3, the main parties which will have access to your data are the following:

  • The qualified person at SAILHERO (administrative services, accountancy, marketing department, commercial, logistic and information officer);

  • The companys in charge of the WEBSITE’s management;

  • The companys in charge of transport and product delivery;

  • The qualified personnel of sub-contractors (if relevant);

  • If applicable, the completent jurisdictions, mediators, accountants, external auditors, lawyers, court bailiffs, debt collection agencies, police or army in case of theft or requisition, emergency services;

  • Any third party which might install cookies on your browsers (computers, pads, smartphones...) upon your acceptance.

 

 

ARTICLE 6. DURATION OF DATA RETENTION 

 

The collected data is stored for 10 years.

 

ARTICLE 7. YOUR RIGHTS

 

According to the French Data Protection Act and to GDPR, you have the following rights: 

  • Right to restriction or erasure of your personal data (article 17 GDPR), in case of inaccuracy, incompleteness, ambiguity,  obsolescence, or if the collection, the use, the communication or the storing is not allowed (more information)

  • Right to data portability of the provided data where: the processing is carried out by automated means and is based on consent or on a contract (article 20 GDPR

  • Right to decide how your data is processed post-mortem and how we transfer (or not) your data to a third party designated beforehand (more information).

 
In case of death and without any instructions on your behalf, we commit to erasing your data, unless its conservation is necessary due to legal requirements.

ARTICLE 8. CONNECTION DATA AND COOKIES

 

On our website, we use connection data (date, time, IP, phone protocol, viewed pages) and cookies (small bits of information saved on your computer) which allow us to identify you and to remember the viewed pages and to measure the usage of our website.

You can consent to, refuse or choose the types of cookies you accept to install in your computer’s browser.

 

ARTICLE 9. SECURITY

 

SAILHERO and its possible subcontractors are committed to imply any technical and organisational means to ensure the processing and the confidentialit of your personal data in compliance with the French Data Protection Act and the General Data Protection Regulation (GDPR).

 

As such, SAILHERO takes any useful precaution, with regards to the nature of your data and the risks of their processing, to ensure the data security and prevent its modification, damage or an unauthorised access by a third party (on-premise physical protection, authentification process of our clients, their personal and secured access via the use of identifers and confidential passwords, connection metrics, encoding of certain data...).
